General Terms and Conditions
I. Basic Provisions These General Terms and Conditions (hereinafter "Terms") are issued pursuant to Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter "Civil Code"). RECART s.r.o., ID: 14330504, VAT ID: CZ14330504, registered office: Cyrila a Metoděje 66, 441 01 Podbořany, registered at the Regional Court in Ústí nad Labem, Section C, Insert 48526. Contact details: e-mail: hello@recart-sim.com, tel: +420 603 838 464, web: shop.recart-sim.com (hereinafter "Seller"). These Terms govern the rights and obligations between the Seller and a natural person acting as a consumer or within their business activity (hereinafter "Buyer") via the web interface at shop.recart-sim.com. The Terms are an integral part of the purchase contract.
II. Information on Goods, Prices, and Reviews Prices include VAT and related fees. Discounts: If a discount is provided, the Seller informs the Buyer of the lowest price offered during the 30 days prior to the discount. Reviews: The Seller ensures that published reviews come from consumers who actually purchased the goods. Product presentations are informative; the Seller is not obliged to conclude a contract.
III. Orders, Pre-orders, and Contract Conclusion The Buyer orders by clicking "Order with obligation to pay". The contract is concluded upon delivery of the order acceptance to the Buyer's e-mail. Pre-orders: Goods marked as "Pre-order" can be reserved. The Seller reserves the right to adjust the final price (e.g., due to changes in manufacturer prices). Both parties may withdraw from a pre-order reservation at any time. Delivery times are indicative.
IV. Customer Account The Buyer must provide correct data and keep it updated. Access is password-protected. The account may not be used by third parties.
V. Payment and Delivery Ownership passes to the Buyer only upon full payment. Risk of damage passes upon receipt. Usage: The Buyer must use the goods according to the manual. The Seller is not liable for damages caused by improper use or assembly.
VI. Withdrawal (Returns) Consumer: 14-day right to withdraw from receipt. Return costs are borne by the Buyer. Entrepreneur (Business ID): No 14-day withdrawal right unless agreed otherwise. Value Reduction: The Buyer is liable for any reduction in value caused by handling the goods beyond what is necessary (e.g., scratches from trial assembly).
VII. Defective Performance (Claims) Consumers: 24-month warranty. Claims must be settled within 30 days. Entrepreneurs: 12-month warranty. The 30-day settlement period does not apply; claims are settled as soon as possible.
VIII. Personal Data Processing is governed by GDPR and the "Privacy Policy" document available on the website.
IX. Dispute Resolution The Czech Trade Inspection (ADR) or the EU ODR platform (http://ec.europa.eu/consumers/odr) may be used for out-of-court settlements.
X. Final Provisions - EU Consumer Protection Clause
Choice of Law and Consumer Rights: All legal relations between the Seller and the Buyer are governed by the laws of the Czech Republic. If the Buyer is a consumer habitually resident in another Member State of the European Union, this choice of law does not deprive the consumer of the protection afforded to them by the mandatory provisions of the law of their country of residence. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
